Policies, Terms & Conditions of Use
Our Billing Policies:
- Payment in advance is required for all plans and is due by the
anniversary of their signup date for the next period of service. Monthly,
semi-annual, and annual payment plans are available. All sales are in monthly
increments.
- Accounts choosing " check " billing method must
send in the first month's payment to the Quik Internet of Metrolina office at
3816 S. New Hopoe Rd Suite 3 Gastonia, NC 28056 so that it is received within seven
(7) days of activation to maintain the account in good standing. If payment is not
received within ten (10) days from the date of activation, the account will be put on
hold.
- All accounts that are 30 days late on their payments will be put on
hold (denied access) until full payment is received.
- All accounts that are 45 days late on their payments will be deleted
from the Quik server and sent to a collection agency. In the
event that any account is sent to a collection agency, the Subscriber may be liable for
collection fees and legal fees if any.
- If a payment for any monthly, semi-annual, or annual plan is
30 days or more past due, the payment will be applied to all outstanding balances first.
The standard monthly rate in effect will be applied on all late payments. Any remaining
balance will be applied towards the next month's payment at the standard monthly rate.
- A $20.00 returned check fee will be assessed for returned
checks. A $10.00 fee for declined credit cards will be assessed for declined credit
card payments.
- Quik Internet of Metrolina may change any fee, rate, or package upon
thirty days notice.
Our Subscribers agree to follow these policies regarding Internet use.
Currently these policies prohibit:
- Any use which violates any applicable local, state, or federal law of the United States of America,
including but not limited to copyright, trade secret, or criminal laws. Quik Internet reserves the right to cooperate with any law enforcement
agencies.
- System abuse is strictly prohibited. Quik Internet of Metrolina may
terminate or modify service immediately and may bill for any resulting support charges if
the client engages in system abuse. Following is a list of actions which are defined to be
system abuse. This list is non-exclusive; any action about which there is any doubt should
be referred to Quik Internet of Metrolina for evaluation.
Actions
which constitute system abuse include, but are not limited to:
- attempting to circumvent user authentication or security of any
host, network, or account on Quik Internet of Metrolina systems or the Internet at large
("hacking")
- attempting, in any way, to interfere with or deny service to any
user or any host on the Internet
- forging email or USENET posting header information
- sending large numbers of unsolicited mail messages (i.e. "junk
mail"); this includes adding or attempting to add addresses to any mailing list without
explicit positive consent of the addressee, commonly known as "spamming"
- forwarding or posting "chain letters" (multiple
forwarding) of any type
- posting inappropriate messages to USENET newsgroups e.g., posting
large numbers of unsolicited posts indiscriminately ("spamming"), or posting
encoded binary files to USENET newsgroups not specifically named for that purpose
- attempting to cancel, supersede, or otherwise interfere with email
or USENET posts other than one's own
- engaging in harassment, whether through language, frequency, or size
of messages
- using an account at another provider to promote a Quik Internet
Metrolina Web site in an abusive manner
- using a Quik Internet of Metrolina account or network connection to
collect replies to messages sent from another provider which violate these rules or those of
that provider
- reselling Quik Internet of Metrolina services to third parties who
do not abide by these guidelines.
- Any use to make unauthorized entry to other computers,
computer information, or communication devices or resources
- Uploading or downloading files without the consent of the
copyright or patent owner
- Quik Internet of Metrolina and Quik International have every
intention to keep all aspects of subscriber accounts private, but it is impossible for
Quik Internet of Metolina and Quik International to guarantee that any activity done while
using it's service will be completely private. Subscribers can increase their level of
privacy by using data encryption. Privacy is not guaranteed. Subscribers are responsible
for their Internet accounts. Ask us to change your password often to enhance security and
prevent unauthorized use of your account
- Users under 18 years of age may not apply for this service without
parental approval
- Subscribers specifically agree to defend, indemnify, and hold
harmless Quik Internet of Metrolina and Quik International, it's agents, officers,
directors, employees, successors, and assignees, from any claim, loss, or damage,
including costs and attorney fees, arising out of or related to any act of omission of the
Subscriber under this agreement, including without limitation the Subscribers causation of
such damages or injury, directly or indirectly, to any party
- The Subscriber understands and agrees that the
Internet is a conglomeration of on-line data bases operated by distinct entities having no
business or legal relationship to Quik Internet of Metrolina or Quik International. Quik
Internet of Metrolina and Quik International do not have input whatsoever as to the
content of Internet data accessed via the service. Subscribers are solely responsible for
any value or reliance it places on information obtained via the Internet or this service.
Information derived as a result of this agreement is provided "AS IS" and at the
subscribers own risk.
Should any action by any subscriber in violation of these
limitations or policies result in a disruption or interference with Quik Internet of
Metrolina or Quik International's network operation, the subscriber will be disconnected from further service.
Others:
Multiple logins on one account - User agrees that
the use of the account is limited to the person or business whose name appears on the
account & dependents of the user at the same address. Multiple logins
from the same user at the same time are prohibited. An additional charge will be applied
to a user who initiates multiple logins or the account may be terminated.
Cancellation of Service - In the event of
cancellation of service, user is responsible for the full current month's charge.
Cancellation notices must be submitted by U. S. mail to Quik Internet of Metrolina 3816 S.
New hope Rd. Suite 3 Gastonia, NC 28056 or e-mailed from the users Quik Internet account
to clt@clt.quik.com. Any account balance remaining must be paid in full within 10 business
days of cancellation to avoid legal action and or reporting to credit agencies.
- Users Files - Quik Internet of Metrolina is not
responsible for user's files stored on our servers. User is responsible for independent
backup of data. Quik Internet of Metrolina reserves the right to delete users files after
cancellation of service.
